Privacy Notice
This Privacy Notice explains how and why Mackwell Health uses personal information, and the rights you have in relation to the information we hold about you.
About us - the Data Controllers
We are Mackwell Health Limited, a company registered in England and Wales (Company No. 13364785) with its office at Hayward Industrial Park, Vigo Pl, Walsall WS9 8UG. We are listed on the Information Commissioner’s register of data controllers under number: ZB162450.
How we use your information
We use personal information to answer enquiries, assess compatibility or partnership requests, manage pre-order interest, provide requested product information, administer our business relationships, comply with legal duties, and keep a record of communication preferences. Our lawful basis for responding to a request is normally our legitimate interests in operating our business and communicating with prospective customers and partners, or taking steps at your request before entering a contract. Where you separately choose to receive occasional product and service updates, we rely on your consent. You can withdraw that consent at any time without affecting our response to your original request.
What information we collect
Website forms may collect your name, organisation, work contact details, country or territory, role, products or devices of interest, estimated quantity, and information you choose to provide about your enquiry, facility or intended application. Required fields are limited to the information needed to understand and answer the relevant request; other fields are optional. Please do not submit patient names, health information or other special-category personal data through these forms. We may also receive ordinary business contact information from professional or public sources when this is relevant to a genuine business relationship.
Marketing
We will use details submitted through a website form to respond to that request. We will only use those details for separate, ongoing product or service updates where you have selected the optional marketing checkbox. Marketing consent is not required to submit an enquiry or pre-order request. You can withdraw consent using the unsubscribe option in a marketing email or by contacting info@mackwell-health.com. We may retain a minimal suppression record so that we continue to respect an opt-out.
Visitors to our websites
The current website does not load advertising pixels or non-essential analytics. Our hosting and security providers may process limited technical information, such as IP address, browser details, requested URL and timestamps, to deliver the site, prevent abuse and maintain security. We do not use this technical information to identify visitors for advertising.
Security and performance
The website is delivered over HTTPS. Access to submitted information is limited to people and service providers who need it for the purposes described in this notice. We use reasonable technical and organisational controls to protect personal data, but no internet or email transmission can be guaranteed completely secure.
Website form delivery and service providers
Website enquiries are transmitted to our server and delivered to our business email inbox using Resend, an email delivery provider acting on our instructions. The submitted fields are included in the resulting email so the appropriate Mackwell Health team member can respond. We do not place form submissions in a website database. Our hosting, security and email providers may process data in the United Kingdom, European Economic Area or other countries. Where personal data is transferred internationally, we require an appropriate legal safeguard such as an adequacy decision or approved contractual clauses.
How long we keep website enquiries
We keep website enquiries and related correspondence only for as long as reasonably needed to answer the request, manage the resulting business relationship, meet legal or regulatory requirements, and establish or defend legal claims. Enquiries that do not lead to an ongoing relationship will normally be deleted from active mailboxes within 24 months. Records connected with a contract, product safety, regulatory obligation or dispute may need to be kept longer under the applicable retention schedule. Marketing preference records are kept until consent is withdrawn, after which a minimal suppression record may be retained.
People who contact us via social media
If you contact us through a social media platform, that platform will process your account details and message under its own privacy terms. We use the message to respond to you and will only copy it into our own records where this is reasonably necessary to manage the enquiry or resulting business relationship.
People who email us
We use Transport Layer Security (TLS) to encrypt and protect email traffic in line with government guidance. If your email service does not support TLS, you should be aware that any emails we send or receive may not be protected in transit. We will also monitor any emails sent to us, including file attachments, for viruses or malicious software. Please be aware that you have a responsibility to ensure that any email you send is within the bounds of the law.

Recruitment - what information we ask for, and why

The information we ask for is used to assess your suitability for employment. You don’t have to provide what we ask for but it might affect your application if you don’t. How long recruitment information is retained for
If you are successful, the information you provide during the application process will be retained by us as part of your employee file for the duration of your employment plus 6 years following the end of your employment. This includes your criminal records declaration, fitness to work, records of any security checks and references. If you are unsuccessful at any stage of the process, the information you have provided until that point will be retained for 6 months from the closure of the campaign. Information generated throughout the assessment process, for example interview notes, is retained by us for 6 months following the closure of the campaign. Equal opportunities information is retained for 6 months following the closure of the campaign whether you are successful or not.

Access to personal information
Mackwell Health tries to be as open as it can be in terms of giving people access to their personal information. Individuals can find out if we hold any personal information by making a ‘subject access request’ under the General Data Protection Regulation and Data Protection Act 2018. If we do hold information about you we will: give you a description of it; tell you why we are holding it; tell you who it could be disclosed to; and let you have a copy of the information in an intelligible form. To make a request to Mackwell Health for any personal information we may hold, please put the request in writing addressed to our Information Governance department at the address provided below. If you agree, we will try to deal with your request informally, for example by providing you with the specific information you need over the telephone. If we do hold information about you, you can ask us to correct any mistakes by, once again, contacting the Information Governance department.
Disclosure of personal information
In many circumstances we will not disclose personal data without consent. However, when we investigate a complaint, for example, we will need to share personal information with the organisation concerned and with other relevant bodies. You can also get further information on: agreements we have with other organisations for sharing information; circumstances where we can pass on personal data without consent, for example to prevent and detect crime and to produce anonymised statistics; our instructions to staff on how to collect, use and delete personal data; and how we check that the information we hold is accurate and up to date.
